The following Terms and Conditions relate to all activities undertaken by Tri Training Harder LLP.

1.1    Definitions

The above named organisation from this point forward will be referred to as “Tri Training Harder LLP”.

All Clients both prospective and successful from this point forward will be referred to as “The Client”.

The term “First Named Client” will be used where group bookings are made and refer to the individual responsible for making the booking on behalf of a number of Clients.

2   Training Camps

Athlete Waiver 

2.1       Booking

The Client’s contract is with "Tri Training Harder LLP"

By Completing the Booking Form you are understood to have read and have agreed to the terms outlined in these terms and conditions.

Bookings are only confirmed when a full payment has been made by The Client or in the case of group bookings by the “First Named Client” (who must be 18 years or older). However, all items including bike hire and related items can only be confirmed on completion of the secondary booking form which the client shall receive instructions on completion within 2 working days of making a booking and payment being received. This form should be completed as soon as possible to confirm availability. If the form has not been completed by one month prior to the camp, Tri Training Harder LLP cannot guarantee that all items will be available for the camp. Especially in circumstances where the client is given adequate time to complete the secondary booking form but does not do so. Adequate time is considered as any time over one week after receiving the confirmation email by Tri Training Harder LLP. Failure to do so will mean that additional fees may be charged to the client.

The first named client is responsible for making all payments on behalf of the group and ensuring all members of the group complete the secondary booking information to confirm any additional extras including bike hire and transfer collection times which may already be paid for. Failure to do so will mean that additional fees may be charged to a first named client. 

2.2       Your Contract

A binding contract between Tri Training Harder LLP only comes into existence when we confirm your booking by email or writing. Until that point all bookings are provisional and subject to availability. 

2.3       Payment

Full payment must be paid to secure your booking. The balance of the payment must be received by us within one month of the initial booking. If the camp is booked within one month of the arrival dates, full payment must be made immediately.  If payment is not received in full and on time, Tri Training Harder LLP reserves the right to treat the booking as cancelled by The Client. In this case the cancellation charges set out in section 2.5 below will apply.

 2.4       Changes By The Client

Should Clients wish to make any changes to their arrangements after being confirmed they are requested to advise us in writing or by email as stipulated in 2.5. Whilst Tri Training Harder LLP will endeavour to meet the Client’s requirements, Tri Training Harder LLP cannot guarantee we will be able to meet all requests.

If prevented from attending a camp, individuals may be able to transfer their place to a named individual (Introduced by The Client); this change of name is based on the understanding that Tri Training Harder LLP are informed prior to arrival date. Tri Training harder reserves the right to refuse name changes if the proposed individual has been asked to leave a previous training camp.  

2.5       Cancellation by the Client

Cancellation by The Client must be made in writing or by email to the addresses in part 1.2. Our written reply to you will be deemed as evidence of confirmed cancellation. We cannot however be held responsible for e-mails which are sent but not received and therefore strongly advise that Clients ensure that any cancellation has been made in the manner requested above. 

In the event of a cancellation of the booking by the Client after the full payment has been made The Client will be entitled to a 50% refund on the total amount paid so long as the cancellation is made 1 months prior the scheduled arrival date. With respect to cancellations after this point in time, The Client will remain liable to pay the full booking fee and no refund will be issued. The period before arrival will be determined by the day we receive your written cancellation. The Client may transfer a cancelled booking to another date by paying 50% of the total cost of the new booking.

2.6       Changes by Tri Training Harder LLP

 Whilst unusual, it could at some stage be necessary to make minor alterations to the booking and other details both before and after bookings have been confirmed. Although most changes will be minor ones, we reserve the right to do so but will advise you of any issues arising from such changes.

If it is necessary to make a significant change before arrival, we will advise you as soon as is practicable. We will then offer you the choice of: accepting the changed arrangements notified to you, purchasing an alternative training camp, or cancelling your holiday and receiving a full and prompt refund of all monies paid to us. 

2.7       Cancellation By Tri Training harder LLP

It may be necessary to cancel a confirmed holiday due to circumstances beyond our control and we reserve the right to do so. If your holiday is cancelled by Tri Training Harder LLP, we will provide you with an option to book an alternative holiday with us or a full and prompt refund of all monies you have paid to us.

2.8        Unforeseen Circumstances 

We regret we cannot accept liability or pay any compensation where the upholding of our contractual obligations isprevented or affected by reason of unforeseen circumstances. In these booking conditions, unforeseen circumstances are considered as any event which we the supplier of service in question could not, even with all due care, foresee or avoid. Such events may include but is not limited to: war or threat of war, government restrictions or the exercise of government authority, riots, civil strife, terrorist activity, industrial disputes, Acts of God and fire.

2.9        Liability to The Client

Tri Training Harder LLP accepts responsibility for ensuring that all parts of the agreed contract are properly performed. This applies except where any failure to perform, or improper performance is due to: your own acts and/or omissions, or those of a third party not connected with the Tri Training Harder LLP in the provision of your holiday and which were unforeseeable or unavoidable, or an event which either ourselves or the supplier of the services in question could not have foreseen or forestalled, even with all due care.

In the case of loss and/or damage to luggage or personal possessions (including money) we cannot be held liable, consequently we recommend you take out correct travel and Training insurance at the time of booking.

In all cases, other than where personal injury or death results, our liability is limited to the price paid by the affected Client(s). It is, however, a condition of our acceptance of liability for any loss other than personal injury of death that you notify us of any claim in accordance with section 2.10 “complaints”.

2.10     Complaints

Should you have any reason to complain you must immediately notify Tri Training Harder staff who will endeavour to assist. If you are still not satisfied on your return home, you must write to or email us with full details of your complaint within 5 working days of the end of your holiday. Regretfully, we cannot accept liability in relation to any complaint which is not notified entirely in accordance with this clause.

2.11     Behaviour

We expect all our clients to have due consideration for other people both on the camp and in the locality. If, in our opinion, or in the opinion of any other person in authority, you behave in such a way as to cause distress, danger or annoyance to any third party, or damage to property, we reserve the right to terminate the holiday of the person concerned without notice. In this situation, our responsibilities towards that person (including any return transport arrangements) will immediately cease and we will not be responsible for meeting any costs or expenses they may incur as a result. We will not make any refunds or pay any compensation.

2.12     Risk and Insurance

Clients should recognise the inherent risks in the activities you will participate in and agree to accept complete responsibility for any injury, damage or loss caused by you as a result of your participation in those activities. You will be requested to sign a waiver before your arrival, which outlines your acceptance of the risks as part of your participation in the activities at Tri Training Harder LLP. This does not remove our legal duty of care but is simply used to highlight your acceptance of the risks inherent in the activities in which you are participating.

With respect to injury to Tri Training Harder LLP staff, or loss or damage to Tri Training Harder LLP property, or that of any third party, full payment for any such injury, damage or loss, must be made by you at the time to the party concerned. And Tri Training Harder LLP are in no way responsible for any claims (including legal costs), subsequently made against any party as a result of your actions.

Tri Training Harder LLP strongly advises that Clients are adequately covered by holiday and travel insurance. This policy should include emergency medical care, cover for personal injury, including cover for activities specific to your itinerary, loss or damage to your luggage, loss or damage to equipment hired or borrowed from us or third parties, repatriation, legal expenses cover and the associated expenses associated with cancellation or curtailment of their booking. We strongly recommend that any European citizen obtains an European Health Insurance Card prior to arrival on the camp.

Please note that some insurance policies exclude cycling except by way of transport. Clients will need additional cover as the cycling activities undertaken exceed this description of  ‘transport.’

2.13     Passports and Visa

It is entirely your responsibility to be in possession of a valid passport and any necessary visas or documentation. Please note European Citizens do not require a Visa for Portugal. International Clients who are unsure of the regulations are advised to contact the appropriate embassy.

2.14     Accommodation and Occupancy

Only the clients named on our Confirmed booking form may stay in or use accommodation and facilities provided by Tri Training Harder LLP. Sharing or sub-letting without prior permission is not permitted under any circumstances.

3        Online Store 

3.1        Ownership of Rights 

All rights, including copyright, in this website are owned by or licensed to Tri Training Harder LLP. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Tri Training Harder LLP.  

3.2       Accuracy of Content 

Tri Training Harder LLP has tried to accurately describe all goods including prices. All prices are displayed inclusive of VAT. Packaging may vary from that shown. We have tried to portray images accurately, but due to individual computers, colours may be incorrect. Tri Training Harder LLP shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

3.3       Damage to your Computer

Tri Training Harder LLP tries to keep this website virus free. However, we cannot guarantee that your use of this website or any linked websites through it will not cause damage to your computer. Tri Training Harder shall not be liable for any damages to your computer through use of this website. It is the user’s responsibility that they have adequate Anti-Virus cover or otherwise for their computer.   

3.4       Availability of Goods 

All items are subject to availability. We will inform you as soon as practically possible if the goods you have ordered are not available. 

3.5       Ordering Errors

You are able to correct errors on your order up to the point at which you click on "submit" on the final page of our ordering process.  

3.6       Delivery Charges

All Postage and Packing charges are encumbered within your order, there are no surcharges unless the user requires a faster delivery than the standard delivery offers. The Client will be required to pay any excess.

3.7       Acknowledgment and Acceptance of your Order

We will notify you by email as soon as possible to confirm receipt of your order and email you again to confirm despatch of the product(s) ordered.  

3.8       Cancellation Right

Under the distance selling regulations you have the legal right to cancel your order within seven working days of receipt of the goods. You will only be able to exercise this right if you are able to return to us the goods you ordered. For details of how to exercise this right please see our payments and refunds section. 

3.9       Links to Other Websites

We have placed links on this website to other websites we are partnered with. Tri Training Harder LLP cannot accept any liability in respect of the use of these websites.

3.10  Exclusions of Liability

Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Tri Training Harder LLP or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with English Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
